European Union

The European Union (EU) has approved the use of Ozone generated from Oxygen for use in various applications including swimming pools and spas, subject to certain registration requirements. As a result, any product sold that generates ozone from oxygen for these purposes must be registered with the EU prior to July 1, 2024. As of that date, non-registered products may no longer be sold in the EU. This extends to ozone generators installed on new hot tubs and swims spas and ozone generators sold as accessories or service parts.

Discussions with an EU-based legal counsel indicates that as of that date, hot tubs already in inventory in EU warehouses or stores (and containing ozone generators) can still be sold only if they have been subject to a temporary Marketing Authorization application.

EU legal counsel also advises that once an ozone generating device has been registered and approved, spas or other products that contain that device may be sold without further registration or approval. We have also confirmed that the process is time-consuming. Therefore, manufacturers are urged to act quickly.
